At this hearing via Zoom, Bernard Collaery’s lawyers applied to Justice Mossop to ask for an extension of the 7 day appeal period applicable to the subpoena issue. Given the complexity, the large written submissions filed and the gravity of the matter they asked for 21 days. The Commonwealth and the CDPP consented but Judge Mossop declined and said the Court of Appeal could be approached.
The judge then ordered the Registrar to list the trial after 15 October 2022 regardless of Counsel availability. He stood firm on this decision, regardless of the fact that Philip Boulton SC, a prime member of the team that has been defending Collaery for four years, has jury trials in October and beyond.
